In General
What you should consider when returning from the United States to live in Canada:
Category 1 – With respect to properly exiting the United states
– properly abandoning the Green Card
– filing your final tax return properly
– are you a “long term resident“? Are you subject to the 877A Exit tax rules?
Category 2 – With respect to reestablishing your self in Canada
– establishing tax residency in Canada properly
– determining the proper basis of assets you own when you move to Canada hint: it’s the fair market value of the assets at the time that you establish tax residency in Canada
Category 3 – Understanding hour your U.S. assets (or other foreign assets) would be treated by Canada (from a tax and reporting perspective)
– Form T1135 and other reporting requirements
Category 4 – Understanding how your Canadian income streams, assets and financial accounts should be reported to the IRS while you still have the Green Card
– both Green Card holders and U.S. citizens are permanent tax residents of the United States even when they live outside the United States
– U.S. citizens and Green Card holders are required to file a large number of information returns when they live outside the United States. A partial list of the forms is here – See Appendix A below.
Category 5 – Possible immigration issues with a non-citizen spouse or family member
– only Canadian citizens or permanent residents of Canada or those with an appropriate visa/permit have the right to live in Canada
Category 6 – Unknown unknowns:
– depends on your personal circumstances.
